LEGAL BASIS FOR PARTICIPATION IN INSTAGRAM SWEEPSTAKES
1.- COMPANY ORGANIZING THE PROMOTION
The company Quémono Atelier, S.L. with address at C/Aviación Española 3, 1º izquierda is organizing a sweepstakes for promotional purposes for the followers of its Instagram profile (hereinafter, “the Promotion”) The contest is nationwide, to be carried out through the Internet, exclusively for users residing in the peninsula and of legal age in accordance with the provisions of the conditions for participation.
2.-START AND END DATES
The Promotion will start on January 25, 2022, and will end on February 1, 2022 (until the winner is announced).
3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The requirements for participation are as follows:
- Be of legal age and reside in the Iberian Peninsula.
- Follow the account @quemonoatelier on instagram
- Like” the photo that announces the drawing
- Add a comment with your favorite outfit/garment from the brand.
Each person who meets these requirements will have an entry in the drawing.
CONDITIONS OF THE PROMOTION AND PRIZES
One winner and 3 alternate(s) will be drawn by lot on February 1, 2022. The result will be communicated to the contestants at the same time.
The winner will get as a prize: a voucher for 200€ that can be exchanged for a dress or a set of child (pants + shirt) or baby Quémono (pants + shirt). Products will be chosen by the winner, but are subject to availability. The products will always be standard, non-customized models of the collection. The winner will be able to customize the sizes, lengths, colors and trims or will be able to add more products by paying the relevant supplements.
5.- LIMITATIONS
If it becomes evident that any of the participants do not comply with the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.
The following persons are not eligible to participate in the Promotion: (i) Employees employed by any of the companies and other entities with legal personality linked to Quémono Atelier, (ii) Individuals who directly or indirectly participate in the capital of Quémono Atelier, (iii) Any other natural person who has participated directly or indirectly in the organization of this Contest or has been directly or indirectly involved in its preparation or development (agency, suppliers, etc.).
The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the Participants, and cannot be exchanged for any other product or money. Nor can it be paid in lieu of an order that has already been placed by a customer.
Quemono Atelier reserves the right to make any change, suspend or extend this Promotion, if there is just cause and prior legal communication.
The winner will be responsible for any fiscal or tax charge that the acceptance of the prize may entail, as well as any other expense derived from the promotion that is not expressly assumed by Quemono Atelier in these Legal Bases.
A period of FIFTEEN (15) calendar days from the date of the awarding of the prize is established to make any reasoned claim. Quemono Atelier reserves, in case of necessity, the right to substitute the prize for another of similar characteristics.
6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, to personal and family privacy and to one’s own image will not be allowed. We will not be responsible for any damage caused by comments made by participants in the Promotion, which at any time may offend the sensibilities of other participants.
7.- EXEMPTION FROM LIABILITY
By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and assumes no responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of Quemono Atelier and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.
8.-INSTAGRAM
The promotion is not sponsored, endorsed, administered by, or associated in any way with Instagram and Entrants release Instagram from any and all liability for any damages arising from the promotion.
9.- PROTECTION OF PERSONAL DATA
The company responsible for the treatment of your data is Quemono Atelier, S.L., with address at C/Aviación española 3, 1º izquierda and identification number B88047113.
Quemono Atelier, S. L. takes the protection of your privacy and your personal data very seriously. Therefore, your personal information is kept secure and treated with the utmost care.
In accordance with the provisions of the applicable regulations on data protection, and specifically in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, each Participant, with the acceptance of these Legal Bases consents that the personal data provided for the participation in this contest will be included in a file owned by Quémono Atelier, S. L. in order to process the participation in the contest and to communicate the prize in case of winning.
We inform you that your personal contact details will be used for the following purposes: to contact you in case you are the winner of the draw and to send the prize by regular mail or courier.
Participants guarantee that the personal data provided are truthful and are responsible for communicating to Quémono Atelier, any changes to them. Quémono Atelier reserves the right to exclude from this promotion any Participant who has provided false information. It is recommended to have the maximum diligence in the matter of Data Protection by means of the use of security tools, and Quémono Atelier cannot be held responsible for illicit subtractions, modifications or loss of data.
Participants are entitled to (i) to access your personal data, as well as to (ii) request the rectification of inaccurate data or, where appropriate, request its deletion, (iii) request the limitation of the processing of your data, (iv) object to the processing of his or her data and (v) request portability. Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in case he/she does not see his/her rights satisfied.
The Control Authority to which the complaint has been submitted shall inform the complainant of the progress and outcome of the complaint.

10.- CHANGES
We reserve the right to modify or extend these promotional terms and conditions, to the extent that it does not prejudice or undermine the rights of the participants in the Promotion.
11.- APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of Madrid will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
